Terms of use

Droptide is a game. These are the terms you agree to by playing it, on the web or as the iOS app. They are short on purpose, and there is nothing hidden in them.

The short version

Play as much as you like. The web version is free; on iOS one optional purchase opens Riptide, Undertow, Auto and three palettes, and Apple handles the money and the refunds. Don't resell it or tamper with it. It is offered as it is — if it stops working, you have lost a game, and that is the extent of what either of us is on the hook for.

Playing it

You may play Droptide for your own enjoyment, on as many devices as you like, for as long as it is available. That permission is personal and non-exclusive; it is not a transfer of ownership. The game, its code, its artwork, its sounds and its name stay ours.

What you may not do: sell it, rent it, or redistribute it as your own; strip or hide the purchase; or modify the game in order to defeat the purchase, forge a leaderboard score, or attack the site or the people playing on it. Nothing here is meant to stop you reading the page source, taking it apart to learn from it, or doing anything else your local law allows regardless of what a licence says.

The purchase

The Full Tide is a single, one-off, non-consumable purchase in the iOS app. It unlocks the Riptide, Undertow and Auto modes and the Voltage, Coralline and Silverpoint palettes, permanently, on any device signed in to the same Apple ID. There is no subscription and nothing recurring.

Prices, and what is behind the purchase, may change for future buyers. What you have already bought is not taken back.

Your scores

Best scores are kept on the device you set them on. Clearing your browser's site data, playing in a private window, switching browsers or deleting the app will lose them, and we have no copy to restore — see Privacy for exactly what is stored where. On iOS, Game Center leaderboards and achievements live with your Apple account and survive all of that.

Leaderboards are meant to rank people who played the game. Entries produced by modifying the game, the device clock, or the traffic between them may be removed, by us or by Apple, without notice.

It is offered as it is

Droptide is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. It is not promised to be uninterrupted, error-free, or fit for any particular purpose. It needs WebGL2 and a reasonably current browser, and it may not run everywhere.

The game may change: modes, tuning, colours and scoring are all subject to being made better, which sometimes means made different. The web version may be taken down, and the app may stop being updated. Where either happens, anything already bought stays yours on the devices that have it, for as long as the app runs there.

Liability

To the extent the law allows, we are not liable for indirect or consequential losses arising out of playing Droptide, and our total liability for any claim relating to it is limited to the amount you actually paid for it — which, for most people, is nothing. Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, in which case those parts simply do not apply to you.

Children and purchases

The game is rated 4+ and contains no user-generated content, chat or advertising. It does contain one in-app purchase. If a child uses your device, Apple's Ask to Buy and Screen Time settings are the way to control what can be bought; a purchase made on your Apple ID is made under your account.

Apple

For the iOS app, Apple's Licensed Application End User Licence Agreement also applies, and where it conflicts with these terms for that version, it wins. Apple is not a party to these terms and has no obligation to provide support for the app, but Apple and its subsidiaries may enforce these terms as a third-party beneficiary. Any claim about the app itself — that it does not work, or infringes something — is ours to answer, not Apple's.

Changes to these terms

These terms may be updated; the date at the top says when they last were. Carrying on playing after a change is how you accept it. If a change matters to a purchase you have already made, it will not be applied retroactively to take that purchase away.

Law and contact

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute — without taking away any protection you have under the consumer law of the place you live in. If any part of these terms turns out to be unenforceable, the rest stands.
